Enforcement
What can I do if the other parent or party is not following the possession order?
If a parent has not complied with an order for possession and access to a child, and that parent does not have a valid defense, then the Court may fine or jail the nonpaying parent. The maximum punishment is six months in jail and a $500 fine per violation.
In addition, the Court may put the parent on probation subject to the future compliance with the possession schedule, and order make up possession for the time that was lost by the enforcing parent.
What can I do if the other parent is not paying child support?
If a parent does not pay child support, a lawsuit called a Motion for Enforcement may be filed. The maximum punishment is six months in jail and a $500 fine per violation. The Court may also put the parent on probation subject to the future payment of support.
